The plaintiff claimed the damages relying on the Civil Code and Constitution of the Republic of Poland, in spite of the fact that there are two instances in administrativ3e proceedings. The Court decided for the defendant , accepting arguments brought by Anna Krysiak that liability based on Article 417 of the Civil Code is excluded . Article 417 concerns performance of the public authorities – except situations covered as the exception. Two instances administrative procedure results in the restriction of the government liability only for the harm caused by the final administrative decisions. Non-final decision, being subject of review by the higher authority does not cause direct legal consequences and therefore may not cause any harm.
