Success for attorney-at-law Dr. Mariusz Rypina before the Court of Competition and Consumer Protection

On October 26, 2023, the Court of Competition and Consumer Protection (SOKiK) revoked the decision of the President of the Office of Competition and Consumer Protection (UOKiK) regarding practices that unfairly exploit contractual advantage. In the trial the Court upheld the arguments presented by attorney-at-law Dr. Mariusz Rypina and confirmed that the client he represented had not committed a practice that unfairly exploited contractual advantage. Therefore, there were no grounds for stating such a practice, ordering its discontinuation, and imposing a fine.

This is an important ruling for the entire grain market, as the SOKiK confirmed that buyers and agricultural producers can conclude a sales contract without having to include provisions specific to contract farming.
