In “Parkiet” daily from 21 April a feuilleton authored by professor Marek Wierzbowski and doctor Iwona Gębusia on “The Business judgment rule during pandemic” was published.

The authors of the feuilleton refer to the notion of the business judgment rule, which in some cases enables the managers to avoid liability.

The epidemic threat caused by coronavirus raises fears inter alia in the context of the civil liability of the managers.

This is the reason why, in the current situation connected with the pandemic, the business judgement rule should be interpreted in particular by taking into account macroeconomic conditions, the situation of the company in question and circumstances under which acted the manager.
