Real Property

Within the field of real estate sales and purchase we provide legal support in matters involving financing. We negotiate loans and securities. We have experience in advising investors implementing both residential and commercial schemes and our advisory services also take into account tax matters which are relevant to a given transaction.

We also deal with issues in the field of land use law, in particular the assessment of the usefulness of  a given piece of real estate for a particular project from A use & planning perspective. This assessment includes analyses of zoning and city planning guidelines.

We handle re-privatisation matters and provide a comprehensive range of services for reclaiming real estate or receiving compensation. We also prepare and negotiate contracts for the rental and use of both private and commercial premises.

Construction

We advise investors on all legal aspects of the investment process, including obtaining the necessary permits for each stage of construction projects, from initial zoning permits through to occupancy permits. We also advise on frequently changing environmental laws, and our advice on the initial environmental assessment of a project also takes into consideration the EU environmental law.

An important element of our firm’s practice in the construction sector is comprehensive advice regarding contracts, especially general construction contracts. We draft contracts, negotiate them, and provide support for the parties, both investors and contractors, at every stage of the investment process.

Infrastructural projects

As part of our services, lawyers in our firm advise on infrastructure investment projects, with particular focus on the administrative processes and decisions necessary to have a successful project. We assist with administrative decisions at every stage of infrastructure projects, beginning with zoning permits through decisions needed to obtain legal title to a property (if necessary) and up until the stage of receiving building permit. Our advice in the field of infrastructure investments also includes issues associated with environmental impact assessment of a given investment.

Construction Law Codification Committee

Professor Wierzbowski was the chairman of Construction Law Codification Committee and Wojciech Jacyno was a member of  this Committee, set up by the government of the Republic of Poland to draft a new Construction Law and Land Use Planning Law as a single Act of Parliament to be called the Construction Code.

Marek Wierzbowski is an editor, and our lawyers are co-authors, of several indispensable handbooks for legal practitioners in the field of real estate law and investment law, including commentaries on construction law and land use planning law.
